You are responsible for seeking appropriate professional support if you are in crisis or require clinical or specialized services.
3. No Guarantees of Results
3.1 Coaching and speaking services are collaborative and depend on your participation, choices, and circumstances.
3.2 We do not and cannot guarantee any particular outcome, result, income level, or life change. Any examples of client experiences, testimonials, or outcomes on the Site represent individual experiences and are not promises of results for you.
4. Bookings, Payments, and Cancellations
4.1 Bookings
Clarity Calls and paid coaching sessions are scheduled via our online booking tools or through direct communication. Your booking is confirmed once you receive written confirmation.
4.2 Fees and Payments
Fees for Services are listed on the Site or communicated directly. All fees are payable in USD, unless otherwise specified. Payment instructions will be provided at the time of booking or in your coaching agreement.
4.3 Coaching Agreements
For ongoing coaching packages or mentorships, you may be asked to sign a separate coaching agreement or contract. If there is any conflict between these Terms and the coaching agreement, the coaching agreement will govern for that specific engagement.
4.4 Cancellations and Rescheduling
Cancellations and rescheduling for sessions are handled according to the specific terms in your coaching agreement or contract. Please refer to your agreement for details.
4.5 Refunds
Unless otherwise provided in a specific coaching agreement, all fees paid for coaching and speaking are non refundable once the engagement has begun, except where required by law.
5. Your Responsibilities
5.1 You agree to:
Participate honestly and in good faith in all coaching conversations.
Take full responsibility for your decisions, actions, and outcomes, during and after coaching.
Seek appropriate professional or emergency support if you are in crisis, experiencing mental health symptoms, or otherwise need clinical or specialized care.
5.2 You acknowledge that David Kincaid may decline or discontinue coaching if he believes that coaching is not appropriate or safe for you at this time and may recommend other forms of support.
6. Intellectual Property
6.1 The Site and its content, including text, images, graphics, logos, audio, video, and materials provided during coaching or speaking engagements (the "Content"), are owned by or licensed to David Kincaid Coaching and are protected by copyright and other intellectual property laws.
6.2 You are granted a limited, non exclusive, non transferable license to view and use the Site and any materials provided to you for your personal, non commercial use only.
